It is not under my control right now. JSBurlysflashlights.com is fortunately on a different server.

The timing on this is not good as my dads illness and funeral was a big setback but I will be spending some money on an attorney in the morning I think. Not sure what else I can do.

Given your recent setbacks, maybe this would be a good opportunity to start anew. Maybe you could create a new website domain name, and do a big kick off on here. I am sure you would certainly get as much help as possible.

Maybe something like: "TheOriginalJSBurlys.com"
Any other suggestions, comments?

John, I kind of go along with that. If you have ever thought about renaming your site, now is the time. However, if you don't want to rename it, a fight over the name will take some time and money. So you might think about a temporary change to something else anyway.

Could have been the registration expired, and wasn't renewed in the time allocated. Therefore it was put backup for sale. Don't know if it is the same place or not but there is a TUCOWS for downloading software (shareware /freeware)

Edit :

if you do a whois search, there is an option to make an offer for the domain name. Kinda sucks that people will buy a domain name with the hopes of selling it back to the original owner for more $$.

This happens all the time. It happened to our local police dept. They let the domain expire and somebody bought it and put up a porn site. It was bad, took a long time in court but they got it back eventually. Big hullabaloo.

Ya unless they will sell it to you for not to much $ I wouldn't bother, just get a new site and start over. Keep in mind how much you might want to spend "fighting" to get it back, then offer them 1/2 that for the name, if they say no I would just move on.

Since your name is involved, it definitely hurts to lose the domain, but I agree, it may be a useful time to revamp, especially given your recent problems. I think an URL that has one or more of the words flashlight, light, lights, LED, LEDs, battery, batteries, etc. would work best. Out of the blue, I'm not much inclined to click on a domain with a person's name unless the person is very well known. JMHO.

Registering newly dropped domains (if this is what happened) is a common practice designed to cash in on any residual traffic to that domain. When someone clicks on a link on the page that now comes up when visiting your domain the new owner earns a few cents (pay per click). Better still if someone wants to buy the domain then they may be in for an easy profit.

This has happened to a number of domains I have let drop in the past. The usual pattern is the new owner will keep the domain for a year or two and when the traffic to their PPC page drops off they will not bother renewing their ownership of the domain.

ICANN (the Internet Corporation for Assigned Names and Numbers) is THE body that determines who owns what in the domain name world and they have clearly documented domain name dispute policies and rules. Before paying for legal advice it might be worth having a look here http://www.icann.org/udrp/ to see if you have a case.

JSBurlysflashlights.com is a good website. Controlled by JonSidneyB.

JSBurlys.com is NOT a good website. Controlled by some PPC scammer.

That is unbelieveable that someone would do that. AND put up a store selling similar things. That is deplorable and dishonorable.

The Domain name does not expire until Nov 24. Starting over will be a tough option.

To be honest I get about 2-5 CPF and EDCF sales a week. The lions share of my business is from cavers being told of JSBurlys.com word of mouth and from business cards at events. Also the ShotShow has me as JSBurlys.com.

This one will take alot of work to recover from as I am still trying to pay for the creation of the RCR123s. Things are in trouble and this is just a bit more of it.
