Fenix "D" tailcaps. Who's having what sort of problems?

I got my P2D last week and last night it "went out." I thought it couldn't be the battery 'cause it was a fresh Battery Station that had been working fine with infrequent use for a few days. Usually lights don't just not work when a battery dies.
So this morning I tried a new battery and it wouldn't work. Eventually I got to jiggling the light and found that a little sideways pressure
after the first click would make it come on....then go out...then switch modes.
Really annoying. I was barely able to select which mode I wanted because it kept mode-switching just turning the thing on.

However, I've been using it for actual work today and it has been operating normally for the past 5 hours.

Fenix told me to contact my dealer (lighthound), but now I'm wondering just how well founded my claim is now that the light seems to be working normally.

Make sure the switch retainer ring(metal ring inside the tailcap) is tightened down.
