Anyone having problems with their Spark SK3?

Just bought the Spark SK3 a little less than a month ago and it's acting up! Sometimes it will not turn on, then it will and it flickers then goes dim and dies and sometimes it will not ramp up properly? Sometimes it works great and I can't replicate the problems but when I need it is when it does not work right! It's a fairly cheaplight that I purchased from hkequipment.net so i'm not sure it worth the freight to go back??? What should I do and is this indicative of the quality of Spark flashlights as this is my first purchase from them!
