It is date dependent. If the appropriate time frame has passed(I.e. Complaint filed, response or lack of response, final decision, then it is almost immediate. When PayPal found in favor of my complaint I had funds available in less than 24 hours. I think(always a questionable action) it was around 45 days total but this was a long time ago...

Recent experience has shown a maximum of 10 days from filing to release of my funds for a non shipment of product. The merchant has 3-5 business days to respond. They can try fighting, but it just ties their money up that much longer.
This has also been my experience with PayPal. I've found that PayPal has sided with the buyer in most cases.
