I see that a lot of people are putting a 10440 li-ion battery into their ITP A3 and getting 300 lumens. They say it gets hot fast but works fine on the lower settings and for brief periods on high it's fine.

How does this work. Why would this not burn out the driver? I guess the emitter itself can handle 4.2 V since under load it must come down closer to the 3.6V the emitter is expecting?

The driver is expecting 1.5V to boost up to that level. Does this not harm the driver?

The boost driver will instead act as a direct drive light (with current running through the inductor's resistance/impedance or something limiting current somewhat). It's out of warranty and such. The emitter will get less than 4.2v due to voltage drops in the wiring and voltage drop due to high current draw on the battery.
 
It could harm the driver if you let it get to hot. Holding it in your hand most of the heat is absorbed into you. If you laid it down there is a potential that it would damge the driver or led. I run 10440 in the itp A3 every day. Its about a year old and never had a problem.
 
I dig my A3 and use it often. I've run several different brands of 10440's in it, and it is bright, especially for it's size. However, 300 lumens (even 200) is a stretch. I know this is a bit off of the subject but thought I'd pipe in. As far as the overheating thing... mine gets warm but never hot enough to be a concern.
