Copyrighted. What would you do?

A friend of mine had a problem of someone using photographs from his commercial website.

He sent an E-mail asking them to cease and desist or he would have his lawyer contact them.

The offender responded with an apology and removed his pictures from their website.

Probably the best thing to do if you created a website, copy, drawings, photographs, is to add " Copyright 2003 by ( your name or company name)", somewhere on the page. Then, you have some protection even though you don't register the copyright.

It's been a while since I did photograpy for a living and used a copyright, so the rules may have changed.

Maybe one of our lawyer members could enlighten us further.

Copyright law, especially that related to the internet represents a complex and still developing body of law -- new decisions, particularly those related to jurisdictional matters, matters central to what action a copyright holder might take and the consequences of those actions, continue to appear. Moreover, copyright issues may implicate other substantive Federal law such as the Lanham Act or antitrust statutes, or even state law. There is simply no substitute for finding, retaining and consulting competent legal counsel on these issues. Unfortunately, unless you can get someone to take you on pro bono publico, this will cost you.
