ST5 mode memory

I have a Spark ST5 190nw. I just started using NiMh rechargeable batteries with it and I noticed that it now has no mode memory. Or at least a very short memory. I was using 14500 lithium ion, and everything worked fine. Anyone else have this issue?
 
I can't recall totally, but I remember this being normal behaviour for the Spark. 14500 gives fairly long term memory, the nimh does not.
 
Yes, the instructions mention this: "AA battery with short term memorization". "Short term" seems to be measured in seconds. For me, it's a deal breaker, I'll be selling mine, I'm afraid. No memorization means I have to wait for the headlamp to cycle through until I get the level I want, and I just can't see doing that nearly every time I turn the thing on.

Yeah It's sorta weird that it will memorize with 14500 but not with AA? I think it is still a nice light! I will just use the Lions and be happy with that I guess. I did get a SD52 the other day and have noticed a few differences in the two lights that I seem to think is a little inconsistantcy In Spark.
